The Toowoomba Magistrates Court has fined the contractor for allowing unrestricted access to the scaffolding, whilst parts of the bottom of the scaffolding were missing or unsecured. Some posts and kickboards were not provided as well. The Court noted that Safety systems were in place at the site, however the risk of falls from the scoffolding, or being struck by objects falling from height, were real.
The court took into account the fact that the defendant had no previous WHS convictions, and co-operated with the investigators from WHS Qld.
